For the debtor, such a seizure often becomes a serious problem: it becomes impossible to sell an apartment, re-register a vehicle, use an account, conduct a notarial transaction, or fully manage their own assets.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">At the same time, a seizure is not always a final and unconditional restriction. The law provides cases when a seizure on the debtor&#8217;s property can be lifted through the executor, head of the state enforcement service department, or through the court. The main thing is to correctly identify the basis, prepare documents, and choose the proper way of protection.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">What Is a Seizure of Property in Enforcement Proceedings<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">A seizure of the debtor&#8217;s property or funds is applied to ensure actual execution of a decision. According to the Law of Ukraine \u201cOn Enforcement Proceedings,\u201d the seizure is imposed by the executor by issuing an order on the seizure of the debtor\u2019s property or funds, as well as an order describing and seizing the property.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In practice, the seizure can pertain to various types of assets. Most often, restrictions are imposed not only on real estate or vehicles but also on bank accounts, corporate rights, movable property, and other property rights of the debtor.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The seizure of property may entail the following consequences:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>prohibition of selling an apartment, house, land plot, or other real estate;<\/li><li>inability to re-register a vehicle at the Ministry of Internal Affairs service center;<\/li><li>blocking of bank accounts or specific sums on accounts;<\/li><li>restrictions on registration actions concerning the property;<\/li><li>prohibition of gifting, exchange, or contribution of property to statutory capital;<\/li><li>risk of further description, valuation, and sale of property through electronic auctions.<\/li><\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Thus, a seizure does not always mean actual confiscation of property, but almost always limits the owner&#8217;s right to freely dispose of it.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">When Is a Seizure Imposed on the Debtor\u2019s Property<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">A seizure is applied within the framework of enforcement proceedings when the debtor does not voluntarily execute the decision or when the law allows the executor to take measures to ensure enforcement. This can be a court decision to collect debt, alimony, fines, credit obligations, damage compensation, utility debts, or another decision subject to compulsory enforcement.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Seizure is most often imposed in the following cases:<\/p>\n\n\n\n<ol class=\"wp-block-list\"><li>Enforcement proceedings are opened, and the debtor has not paid the debt voluntarily.<\/li><li>The executor has found assets, funds, or debtor\u2019s accounts.<\/li><li>There is a risk of alienation of property before actual execution of the decision.<\/li><li>It is necessary to ensure collection of the principal debt, enforcement fees, enforcement costs, and fines.<\/li><li>The property is subject to further description, valuation, or sale.<\/li><\/ol>\n\n\n\n<p class=\"wp-block-paragraph\">After the seizure is imposed, the debtor may learn about the problem when attempting to sell real estate, withdraw funds from an account, re-register a vehicle, or conclude a notarial transaction.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">What Property Can Be Seized<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">In enforcement proceedings, a seizure may be imposed on property that belongs to the debtor by ownership right or concerning which there are confirmed property rights of the debtor. For example, some social payments, compensations, aids, and other special payments may have a special legal regime. In such cases, to lift a seizure it is important to obtain documentary confirmation from the bank or another institution about the nature of the account or funds.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Main Grounds for Lifting a Seizure on the Debtor\u2019s Property<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Lifting a seizure is possible not at the debtor\u2019s desire but upon specific legal grounds. Therefore, before preparing an application, complaint, or lawsuit, it is necessary to understand why the seizure should be canceled.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The main grounds for lifting a seizure are:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>full repayment of the debt and related payments in enforcement proceedings;<\/li><li>completion of the enforcement proceedings;<\/li><li>return of the enforcement document in cases where the law foresees cancellation of seizure;<\/li><li>cancellation of court decision or enforcement document;<\/li><li>existence of a court decision on lifting the seizure;<\/li><li>seizure imposed on property that does not belong to the debtor;<\/li><li>violation of the procedure for imposing the seizure;<\/li><li>seizure imposed on funds or accounts that cannot be subjected to enforcement;<\/li><li>impossibility or impracticability of property realization due to its condition;<\/li><li>debt on periodic payments is repaid, and the decision can be ensured by another means.<\/li><\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">The law explicitly provides that in case a court decision on lifting the seizure comes into legal force, the executor must lift the seizure by an order no later than the next day after becoming aware of the relevant circumstances. The executor is also obliged to lift the seizure of funds or electronic money no later than the next working day after receiving documents confirming that such funds are exempt from enforcement.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">How to Lift a Seizure on Property Without Going to Court<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Not every case requires court dispute. This can happen due to technical delays, untimely receipt of funds to the executor\u2019s account, absence of a debtor\u2019s application, or incomplete repayment of enforcement costs.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">After full payment, it is necessary to check whether not only the principal sum of the debt is closed but also other payments:<\/p>\n\n\n\n<ol class=\"wp-block-list\"><li>Principal debt under the enforcement document.<\/li><li>Enforcement fee or basic remuneration of a private executor.<\/li><li>Enforcement proceedings costs.<\/li><li>Penalties, if applied.<\/li><li>Other recoverable payments under the proceeding.<\/li><\/ol>\n\n\n\n<p class=\"wp-block-paragraph\">Upon completion of enforcement proceedings, the seizure imposed on the debtor\u2019s property or funds is lifted, information on the debtor is excluded from the Unified Register of Debtors, and other enforcement measures are canceled as provided by law.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If the executor does not respond, the debtor may submit a repeated written application, complaint about inaction, or apply to the court depending on circumstances.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">If the Seizure Is Imposed on Property That Does Not Belong to the Debtor<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">A separate complex category is the seizure of third-party property. For example, a car actually bought by another person, an apartment belonging to a co-owner, property owned by a spouse, while the debtor is another person.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The law provides that a person who considers the seized property belongs to them, not to the debtor, can apply to the court with a claim to recognize ownership rights to this property and to lift the seizure.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In such cases, it is important to prove not only the wrongful seizure but also the ownership right itself. This can be supported by sales contracts, acceptance-transfer acts, payment documents, registration records, technical passports, extracts from registries, witness statements, and other evidence.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">How to Lift a Seizure on Real Estate<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Seizure of real estate typically becomes known during preparation for sale, gifting, inheritance registration, or other notarial actions. A notary sees the encumbrance in the registry and cannot conduct the transaction until the seizure is lifted.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">To lift a seizure from an apartment, house, land plot, or non-residential premise, you need to:<\/p>\n\n\n\n<ol class=\"wp-block-list\"><li>Obtain an informational certificate from the State Register of Property Rights.<\/li><li>Determine who and within which proceeding imposed the seizure.<\/li><li>Contact the relevant executor.<\/li><li>Prepare documents confirming the grounds for cancellation of the seizure.<\/li><li>Obtain an executor\u2019s order or court decision.<\/li><li>Check the termination of the encumbrance in the registry.<\/li><\/ol>\n\n\n\n<p class=\"wp-block-paragraph\">If the proceeding is old, the enforcement service reorganized, or documents partially lost, the procedure may become complicated. In such cases, archive materials often need to be requested, the successor of the state enforcement service body identified, or court action taken.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">How to Lift a Seizure on a Bank Account<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Seizure of an account is one of the most painful situations for a debtor since it can block salary, pension, social payments, funds of sole proprietors, or current business payments. However, the fact of account blocking does not automatically mean the seizure is lawful for all funds on it.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">To lift a seizure from an account, it is necessary to determine which funds are blocked and whether seizure on them is allowed by law. If the account has a special regime or the funds cannot be subjected to enforcement, you need to get confirmation from the bank or another payment service provider and submit it to the executor.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The action algorithm is as follows:<\/p>\n\n\n\n<ol class=\"wp-block-list\"><li>Contact the bank to find out the basis for blocking the account.<\/li><li>Obtain information about the executor and proceeding number.<\/li><li>Receive from the bank a certificate about the purpose of the account or nature of the funds.<\/li><li>Submit an application to the executor for lifting the seizure from the account.<\/li><li>Add documents confirming the prohibition of enforcement on these funds.<\/li><li>Check if the bank received the order to lift the seizure.<\/li><\/ol>\n\n\n\n<p class=\"wp-block-paragraph\">Especially careful action is required if social payments, aid, compensations, or other funds with a special legal regime are credited to the account.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">How to Lift a Seizure on a Vehicle<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Seizure of a vehicle usually makes its re-registration, sale, or transfer to another person impossible. In such cases, the date of acquiring ownership, payment documents, purchase contract, and vehicle registration details will be crucial.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Complaint Against Executor\u2019s Actions or Inaction<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">If the executor unlawfully imposed the seizure, does not consider the application, does not lift the seizure after debt repayment, or does not send the order to the bank or registrar, a complaint can be filed.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Decisions, actions, or inactions of the executor regarding enforcement of a court decision may be appealed to the court that issued the enforcement document. If it concerns enforcement of decisions of other bodies or officials, the complaint is submitted to the respective administrative court. The law establishes a 10-working-day appeal period from when a person learned or should have learned about the violation of their rights.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The complaint must be written and contain specific circumstances of the violation. Depending on the situation, this may be a claim to lift the seizure on property, a claim to recognize ownership rights and lift the seizure, a complaint against executor\u2019s actions, or another method of judicial protection.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Typical Mistakes When Lifting Seizure on Property<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Many debtors waste time due to the wrong sequence of actions. As a result, the seizure remains in force even when there are grounds for its cancellation.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The most common mistakes include:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>submitting an application without documentary proof of debt payment;<\/li><li>ignoring enforcement fees, proceeding costs, and fines;<\/li><li>addressing the wrong executor or wrong court;<\/li><li>lack of proof of application submission;<\/li><li>attempting to lift the seizure verbally without written submission;<\/li><li>incorrect formulation of claims;<\/li><li>confusion between complaint against the executor and claim for ownership rights;<\/li><li>delays when the property is already transferred for sale;<\/li><li>not verifying the actual removal of encumbrance in the registry.<\/li><\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">To avoid these mistakes, it is necessary first to identify the exact reason for the seizure, check the state of the proceeding, obtain copies of orders, and only then choose the legal mechanism.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">How to Check a Seizure and Enforcement Proceeding<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The check begins by searching for information about the debt, executor, and restrictions. For this, official registries, documents from the bank, notary, Ministry of Internal Affairs service center, or the executor can be used.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Unified Register of Debtors is an online database on debtors maintained to disclose information about unfulfilled property obligations and prevent alienation of debtors&#8217; property. Data is entered into this register by state or private executors after opening enforcement proceedings.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">To check, it is worth:<\/p>\n\n\n\n<ol class=\"wp-block-list\"><li>Check yourself or your company in the Unified Register of Debtors.<\/li><li>Obtain information from the Automated Enforcement Proceeding System.<\/li><li>Order an extract regarding real estate from the State Register of Property Rights.<\/li><li>Check the vehicle before re-registration.<\/li><li>Contact bank regarding the basis of account seizure.<\/li><li>Obtain copies of orders from the executor.<\/li><\/ol>\n\n\n\n<p class=\"wp-block-paragraph\">Often at the verification stage it turns out that the seizure is linked to an old proceeding, a small unpaid amount, or a technical non-removal of encumbrance after the case conclusion.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">What to Do If Property Has Already Been Transferred for Sale<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">If the seized property has been transferred for sale, you need to act quickly.
